Business Law Essay Example | Topics and Well Written Essays - 1500 words
Business Law - Essay Example This paper highlights that à the Council will be liable in negligence for damages to the premises and repair costs. However, where the question of potential losses of profit of 50,000 pounds is concerned, it appears unlikely that the Courts will hold the Council responsible for compensation of such purely economic losses. According to Alderson B, negligence is defined as ââ¬Å"the omission to so something which a reasonable manâ⬠¦.would do, or doing something, which a prudent and reasonable man would not do.â⬠. Two kinds of omissions have been identified; a failure to take appropriate precautions and passive inaction, with the general rule being that there is no duty on a person to take action to prevent harm from befalling others. (Smith v Littlewoods organization Ltd.The Hanby Borough Council may be liable for the failure to take adequate precautions to ensure that flood protection was provided. The omission by passive inaction could also apply in the case of Hanby Council, however it is a public body and therefore has a duty of care to the public to safeguard the premises and prevent the occurrence of flooding. While the general rule of negligence by omission through passive inaction may not impute a duty to prevent harm from befalling others, some of the exceptions that have been identified are when there is an undertaking by the defendant. Ministry of Defence or when the defendant has control over the land or something which could be dangerous if interfered with. Hanby Council had control over the land which had flooded before and caused damages.

Family and sports, recreation, leisure Essay Example | Topics and Well Written Essays - 750 words
Family and sports, recreation, leisure - Essay Example I have come to realize that these SRL activities also changes with time or the generation (Human Kinetics 2005). You notice that the sports recreation and leisure activities that were practiced by our parents or quite different from what we are practicing today. These few factors made me to talk to my mother and my grandmother in an interest to know more about my family generation history in sports, recreation, and leisure activities. Family interviews I had some questions to ask my grandfather; Me: ââ¬Å"Grandfather, did you consider your family as being poor or rich?â⬠Grandfather: ââ¬Å"I canââ¬â¢t say that we were that rich, but my father had enough properties and resources to support the familyââ¬â¢s wellbeing. My father had a large farm and livestock, he was a great farmer. Thatââ¬â¢s how he managed to raise the family.â⬠Me: ââ¬Å"Did you enjoy your life?â⬠Grandfather: ââ¬Å"yes I really enjoyed my time very well. As a young boy, I always played to gether with other young boys. I also enjoyed assisting my parents in the farm.â⬠Me: ââ¬Å"What recreation or sports activities did you participate during your leisure time?â⬠Grandfather: ââ¬Å"We had a lot of activities to do. ... When I was young, your grandpa took care of me very well. I used to hang out with the rest of young boys when out of school.â⬠Me: ââ¬Å"What were your favorite sporting and leisure activities?â⬠Father: ââ¬Å"There were many sporting activities we used to play. We played board games, high jumps, bullfights and participated in local wrestling competition. We also did some hunting activities but not often. During the night, we could assemble together in a fire and listen for stories from our grandparents.â⬠The Ties of My Grandfatherââ¬â¢s Generation with the Readings The time of my grandfatherââ¬â¢s youthful age was the time when the communities were still indigenous. The kind of sports, games, and social activities they participated in like dancing and some physical activities were reflecting their culture and a particular way of life. The culture that was adapted was from my grandfatherââ¬â¢s tribe. The tribeââ¬â¢s culture and traditions determined thei r leisure and sporting activities. These physical activities, games, and sports were considered very important means of recreation. The different classes of people played their games and sports differently. My grandfatherââ¬â¢s ethnic community could not interact or play with other ethnic communities (Mackenzie, Para 7). My Generation Sports, Recreation, and Leisure (SRL) Activities All these activities are quite different from the sporting, recreation, and leisure activities that I practice or the current young people are practicing in their free time. Our sporting activities vary from field sports like soccer, rugby, and athletics and so on to indoor games and computer games. I spend my time playing and watching soccer, which

Teaching Strategies Integration Research Proposal
Teaching Strategies Integration - Research Proposal Example He told us that the parent was quite correct, and that he had failed to account for different learning styles. He went on to say that only the grade from then on would count, for that reason, since he felt it was unfair if he left out any of the students. This is how I try to teach my own adult students, both men and women. In this paper I will describe ten of my teaching strategies developed for this purpose. All of these now have different names. According to the researchers who theorized the latest research on them, but they basically represent the major methods for learning. All learner use a combination of them all, with the exception of learners who are lacking the use of one or more physical senses. However, each learner learns more from one of these than the others. So the teacher who taught math using diagram was only addressing the visual learning style, and the students who favoured other learning styles were being left out. This diagram is the most useful for me when I am designing lessons, as it encompasses Kolb`s ideas very well, and includes all five of the methods I mentioned above. However, it adds another dimension, that of procedure and interaction. So try to design each lesson so that it include opportunities to include all of this learning activity and all five learning styles. I do not always introduce the lesson in the same way, as each lesson requires something different to best communicate it content. However, at some time I present it in both visual and auditory fashion. Then I provide a way for the students to discuss the material before giving them an opportunity to apply the learning in some activity. For every lesson I provide notes, though I do not always hand them out at the beginning. Some students take notes, while others just listen. All the students join in the discussion sessions and the hands on activities. Assessment follows using much the same pattern. I require the students to discuss the outcome, write something

What if Alexander Graham Bell Did Not Invent the Telephone Essay
What if Alexander Graham Bell Did Not Invent the Telephone - Essay Example High-end communication devices at present are products of a gradual and consistent innovation of telephone to become cellular phones or the so-called wireless communication devices. Now, consumers are no longer satisfied with the primitive capacity and purpose of telephones or cellular phones which is to be able to hear and talk to important people. With the invention of Internet by Tim Berners-Lee, phones are now capable of surfing the Web, tracking locations, and capturing images. Now, we ask, would we have the kind of luxury and convenience in doing our everyday tasks if, first and foremost, no one invented the telephone? What if Alexander Graham Bell did not think of creating a magnificent machine that allows people to speak to people separated by geographical distance? Well, the answer might vary and would depend on probabilities, like other inventors in the likes of Joseph Henry, who invented the electric telegraph, or Thomas Edison, could actually thought of inventing the tele phone. A reluctant response might be that cellular phones are impossible to surface, and the Internet remains a mystery to the humanity. This essay attempts to present the possibilities if Alexander Graham Bell had never created the electric telephone, and highlights the importance of this invention to humanityââ¬â¢s history. ... Meucci, among other telephone inventors, was reportedly the first ââ¬Å"to have a functioning electric telephoneâ⬠which he attempted to patent (Meucci 9). Then there was Elisha Gray who was also regarded as the one who first patented the telephone close with Bellââ¬â¢s filing of patency in 1876 (Evenson 3). There were conspiracies regarding who really is to be credited for the telephoneââ¬â¢s invention, but the federal government credited Alexander Graham Bell for patenting the telephoneââ¬â¢s creation (Evenson 3). Alexander Graham Bell undoubtedly has been part of the pages of world history. Bell is a notable inventor, scientist, and teacher. Born on March 3, 1847 in Edinburgh, Scotland, Bell was known for his pet name Alec (Feinstein 1). His contemporary, Samuel Morse, also invented a communication device, which was the telegraph, which enables the transmission of electrical impulses that result in dots and dashes (Feinstein 10). These dots and dashes represent the letters of the alphabet and can be interpreted using the Morse code (Feinstein 11). Although he received a patent in 1840, Morseââ¬â¢s electric telegraph had certain shortcomings. It did not cater the needs of ordinary people since it cannot be connected to their respective homes, and second, it was quite expensive. Feinstein wrote that, while the telegraph was a big leap towards the advances in communication, Alexander Graham Bellââ¬â¢s telephone ââ¬Å"truly conquered time and distanceâ⬠and ââ¬Å"create a world in which people were as close to each other as the nearest phoneâ⬠(19). 3.0 Period of Natural Science and Technology Early and late nineteenth century was a period marked by the fall of European and Asian empires and the rise of the German, British, American, and Japanese

Incident Management Team #7 Essay Example | Topics and Well Written Essays - 500 words
Incident Management Team #7 - Essay Example Nature of the incident and the different types of skill sets of the employees determine the members of an incident management team. The line officer is responsible for analysing the nature of the fire incident and to formulate suitable teams to tackle it. He must decide in which category the incident comes and what are the immediate priorities of the teams formed. The line officer must make the team members aware of the nature of the incident and he must provide a brief about the main objectives and immediate objectives of the team in action at the incident place. For example, if the fire causes threat to the life of the people, then the teamââ¬â¢s immediate objectives must be to save the life of the people. Incident Management starts as the smallest unit and then changes the structure of the unit according to the complexity of the emergency. Team development is an important part in the management of a fire incident. The members of an IMT (Incident Management Team) should work as a team, and learn the knowledge and skills needed to perform effectively in stressful, dynamic conditions. ââ¬Å"Team decision-making is a critical aspect of effective IMTs, and this skill must be developed by the team as a whole in an exercise/activity environment so that it can be applied appropriately during an emergencyâ⬠(Incident Management Team Development) In an incident management team, there will be command staffs and general staffs. The type of the incident determines the whether to allocate different positions to the staff or not. The incident management teams are designed to tackle fire and safety related problems. The preliminary aim of the IMTââ¬â¢s is to protect the life and property of the public from the dangers caused by fire like safety issues. As a fire fighter I have to obey the commands from my superiors in saving the life

Answer questions - Coursework Example 2. The movies exposed the dark side of human beings. Capitalism was not the root of the problem at Enron Corporation. The unethical managers created a culture of greed at Enron. Everyone was fouled by the company due to the fact the investors which included thousands of employees thought the financial numbers of the company were legitimate. The upper managers created fake revenues in order to cook up the numbers. A company with ethically responsible upper management would not have suffered through the financial scandal Enron was exposed too. 3. One of the best ways to change the mentality of putting fast profits ahead of ethical behavior is by speaking out against unethical behavior and not supporting companies that are involved in unethical behavior. In the aftermath of the Enron scandal a law that helped bring back confidence in the marketplace was the Sarbanes and Oxley Act of 2002. 4. I believe energy prices should be regulated in order to ensure the customer gets the lowest poss ible price. In the open market companies are going to be looking to earn a reasonable profit. In government controlled regulation the state owned company can operate basically at cost. This helps lower the price of the electricity bill.
